Welcome to Nut Calculator, a dating analytics tool that helps adults understand and optimize their encounters and track their “cost per nut”. We favour plain language, keep pricing straightforward, and refine the product based on community input. Please read these Terms of Use (“Terms”) carefully—by accessing or using any Nut Calculator website, mobile app, API, or related service (collectively, the “Service”), you (“you” or “your”) confirm that you understand and accept everything below.
Eligibility
You must be 18 years or older and legally able to enter a contract. The Service is not for minors and must not be used to store information about minors.
Account Registration and Security
You are responsible for all activity under your credentials. Keep your password confidential and tell us promptly if you suspect a breach. We may suspend or close any account for violation of these Terms, illegal activity, or any other reason in our sole discretion.
Permitted Use
You may use the Service only for personal, non-commercial tracking and analytics related to your own dating life. You agree not to
- scrape, copy, or create derivative works from the Service;
- upload unlawful, defamatory, or discriminatory content;
- reverse-engineer, probe, or bypass security measures;
- harass, threaten, or stalk anyone;
- break any law or regulation.
We may monitor for misuse but are not obliged to do so.
User Content and Licence
You own the text, data, and media you submit (“User Content”). By submitting User Content you grant Nut Calculator a worldwide, non-exclusive, perpetual, royalty-free licence to host, process, reproduce, and display that content to operate and improve the Service.
Feedback: If you send suggestions or ideas, you grant Nut Calculator an irrevocable, royalty-free right to use them without obligation to you.
Intellectual Property
All software, design, graphics, and other materials we provide are the exclusive property of Nut Calculator or its licensors. Nothing in these Terms transfers ownership to you. Nut Calculator, cost-per-nut, and associated marks are our trademarks.
Privacy
Our Privacy Policy explains how we collect, use, and safeguard your data and is incorporated by reference. By using the Service, you consent to those practices.
Modifications to the Service or These Terms
The Service may evolve: we can change, suspend, or discontinue any part of it at any time without liability. We may also update these Terms; material changes take effect 30 days after posting. Continued use after that date constitutes acceptance. If you disagree, stop using the Service and delete your account.
Third-Party Services
The Service may link to or integrate with services we do not control (for example, Creem.io payments or Google Analytics). We are not responsible for the content, security, or privacy practices of third parties.
Disclaimer – No Advice
The Service provides informational analytics only. It is not medical, legal, financial, or relationship advice, nor a guarantee of results. Decisions you make using the Service are at your own risk.
Warranty Disclaimer
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without any warranty—express, implied, statutory, or otherwise—including fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
Limitation of Liability
To the fullest extent permitted by law
- Indirect or consequential damages (lost profits, data, goodwill, and similar) are excluded.
- Our total liability for any claim will not exceed the greater of (i) USD 100 or (ii) the fees you paid in the 12 months before the claim arose.
- We are not liable for failure to perform due to events beyond our reasonable control (natural disasters, government action, internet outages, labour disputes, and similar).
- Where local law disallows certain limits, liability is capped at the smallest amount legally allowed.
Time to bring claims. Any claim must be filed within one year after it arose, unless a shorter period is required by law.
Indemnity
You will defend, indemnify, and hold harmless Nut Calculator and its officers, directors, employees, and agents from any claim, damage, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Service.
Governing Law and Dispute Resolution
These Terms and any dispute or claim are governed by Delaware law (USA), excluding conflict-of-laws rules. All disputes shall be resolved exclusively by final, binding arbitration seated in Belize City, Belize, in English under the ICDR Rules of the American Arbitration Association, except where those rules conflict with this clause.
To the fullest extent permitted by law, you bear every cost of arbitration or litigation—filing fees, administrative fees, arbitrator compensation, attorneys’ fees, expert fees, and all other expenses—regardless of outcome. If a court finds any part of this cost clause unenforceable, the tribunal will apportion costs as required, but Nut Calculator will never be liable for your attorneys’ fees or costs.
You and Nut Calculator waive any right to a jury trial and to participate in a class, consolidated, or representative action. We may seek injunctive or equitable relief in any competent court to protect intellectual property or confidential information rights.
Termination
You may stop using the Service and delete your account at any time. We may terminate or suspend the Service or your access immediately, with or without notice. The clauses titled User Content and Licence, Intellectual Property, Privacy, Disclaimer – No Advice, Warranty Disclaimer, Limitation of Liability, Indemnity, Governing Law and Dispute Resolution, and Entire Agreement survive termination.
Severability and Waiver
If any part of these Terms is held unenforceable, it will be modified only to the minimal extent necessary, and the remainder will stay in effect. Our failure to enforce any right is not a waiver.
Assignment
We may assign these Terms as part of a merger, sale, or other transfer of assets. You may not assign or transfer any rights or obligations without prior written consent.
Copyright and DMCA Takedown
To allege copyright infringement, email a notice to [email protected] that meets 17 U.S.C. §512. We respond to valid notices and may remove or disable infringing content.
Export Compliance
You must obey all applicable export-control and sanctions laws. You may not use or export the Service to embargoed countries or prohibited end-users.
Paid Plans, Fees, and Refunds
We may offer paid subscriptions or one-off purchases. Pricing and any extra terms appear at checkout and are incorporated by reference. All payments are non-refundable. You can cancel a subscription at any time through your account settings; cancellation stops future billing but does not refund past payments, and service remains active until the current paid term ends. We strive to display pricing clearly and to give advance notice of price changes.
Entire Agreement
These Terms, the Privacy Policy, and any additional posted guidelines are the entire agreement between you and Nut Calculator regarding the Service and replace all prior or contemporaneous understandings.
